Auction terms
The rules for bidding on one of 18 removable advertising placements for one 90-day campaign on the Brand My Van vehicle.
Terms version: 2026-08-28
1. The agreement
These terms govern the Brand My Van website, auction, payment, production, installation, display, renewal, and removal of advertising on the vehicle. “Brand My Van,” “we,” and “us” mean the operator of Brand My Van. “Advertiser” and “you” mean the person or business placing a bid.
By submitting a bid or paying for a winning placement, you agree to these terms, the Creative Policy, the Fulfillment Policy, and the Refund and Cancellation Policy. You must be at least 18 and authorized to act for the named advertiser.
2. What a bid buys
- Every bid is stated in U.S. dollars and is the total price for one 90-day placement, not a monthly price.
- Standard removable-print production and standard installation for the selected space are included in the winning price.
- The 90 consecutive calendar days begin on the documented installation date, not the auction close or payment date.
- A placement is not permanent. It is removed after the term unless the advertiser accepts a renewal offer.
- There are no subscriptions, automatic renewals, or automatic recurring charges.
The interactive van preview shows the auction boundaries. Final printable dimensions, safe areas, scaling, and placement are confirmed in a production proof before printing.
3. Public auction rules
The first round has 18 spaces whose suggested starting amounts total exactly $5,589.71. The auction page identifies each space, its suggested starting amount, the current provisional leader, and the scheduled close. Suggested amounts are neither minimums nor caps. When a space has no accepted standing bid, the minimum bid is $0.50. After a standing bid exists, each new bid must exceed it by at least one cent, so tied accepted bids cannot occur. A newly authorized bid may lead publicly while review is pending. At close, the highest approved bid for each space becomes the intended winner; that bidder wins only after the exact bid amount is successfully captured.
Approval requires valid contact information, an active full-amount card authorization, compliance with the Creative Policy, and acceptance under applicable law and payment-processor rules. We may reject or reverse a bid affected by fraud, automation, collusion, a material error, an ineligible advertiser, prohibited creative, or an unauthorized payment method. When a bid is rejected or validly withdrawn, we request release of its uncaptured authorization immediately. The card issuer controls when the released hold disappears from the account.
The site may publicly display the space, bid amount, bid count, auction timing, availability, advertiser name, website, submitted brand artwork, and final winning amount. Email addresses, phone numbers, card details, and private billing information are not public. Submitted artwork may appear provisionally on the public van before final review; rejection removes it and reveals the next eligible bid for that space.
We may pause or cancel a round when a material outage, security event, fraud attempt, or listing error makes the result unreliable. Any such action will be disclosed on the auction page. Shill bidding, bid manipulation, coordinated suppression, scraping that disrupts the service, and bidding without authority or intent to pay are prohibited.
4. Authorize now, capture only the winner
Placing a bid authorizes a card hold for the full bid amount. Stripe asks the card issuer to reserve that amount at bid time, but Brand My Van does not charge or capture it then. This is an authorization or hold, not a cash deposit or payment. If you bid on multiple spaces, or bid again after being outbid, the holds can add together; the bid form shows your known total reserved exposure before you continue.
Outbid authorizations remain in place until every auction space is conclusively finalized. This keeps a still-eligible bid available if a higher bid is later rejected or withdrawn. Once every space is final, Brand My Van immediately requests release of every remaining uncaptured hold. If a space is finalized without a winner, every uncaptured hold associated with that space is released during final reconciliation. Losing holds are released, not refunded, because no money was captured.
At auction close, Brand My Van attempts to capture the full authorized amount of each space's highest approved bid. The winning payment is one payment for the 90-day campaign and cannot exceed that immutable bid amount. A bidder becomes the winner only after capture succeeds, and no more than one bidder may be captured for a space.
If capture fails, the space enters payment recovery for that intended winner. Brand My Van does not automatically charge the next bidder or award the space to anyone else. We may contact the intended winner, retry the same authorization, or send a secure link to complete required authentication or a replacement full-amount authorization. Card-network authorization deadlines vary; you may be asked to reauthorize before the stated capture_before deadline so the bid can remain eligible through settlement.
If recovery does not succeed, Brand My Van may expressly declare that bid forfeited and then expressly select a specific approved fallback bid for one exact capture attempt. A failed fallback attempt does not advance to another bidder automatically. The space remains unresolved until payment is recovered, another specific fallback is approved, or the space is declared no-award.
Card details are handled by Stripe. Brand My Van does not store complete card numbers or card security codes.
5. Artwork, production, and installation
The advertiser must provide artwork it is authorized to use and respond to reasonable proofing requests. We preserve aspect ratio by default and do not intentionally stretch a logo. Cropping, background changes, or other material edits require advertiser approval. Production begins only after the final proof is approved in writing.
Standard printing and installation are included. Non-standard materials, redesign work, or advertiser-requested replacement after proof approval require a separate written quote and affirmative approval; they are never added automatically.
6. The 90-day display term
The placement is displayed during ordinary use of a privately operated cargo van. Routes, mileage, hours on the road, parking locations, audience size, impressions, leads, sales, publicity, and specific geographic exposure are not guaranteed. The placement does not imply that Brand My Van endorses the advertiser.
If collision, repair, vehicle unavailability, or placement damage prevents display for a full calendar day, the campaign receives one replacement day. If extending the term is not reasonably possible, the remedy is a pro-rata refund based on the winning price divided by 90 for each full unavailable day. Ordinary overnight parking, routine stops, and normal personal use are not vehicle downtime. More details appear in the Fulfillment Policy.
7. Renewal
Before expiration, the current advertiser receives the first opportunity to renew the same space for another 90 days at the same campaign price. The renewal notice will state an acceptance deadline. Renewal requires affirmative acceptance and a new one-time payment. If the advertiser declines or does not accept by the deadline, the space returns to auction. Nothing renews automatically.
8. Cancellations and refunds
No bidder is charged merely for losing; an uncaptured authorization is released rather than refunded. Refunds apply only after money has actually been captured. Winner cancellations, production-stage cancellations, fulfillment failures, and vehicle downtime are handled under the Refund and Cancellation Policy. We will not substitute store credit unless the advertiser affirmatively agrees.
9. Advertiser responsibility
You represent that the artwork, names, marks, claims, links, and advertised offer are lawful, accurate, non-infringing, and authorized. You grant Brand My Van a limited, non-exclusive license to resize, proof, print, install, display, photograph, document, and remove the approved creative solely to run and document the campaign.
You are responsible for claims arising from your product, offer, website, or creative, including intellectual-property and advertising claims. Brand My Van may remove creative that later becomes unlawful, unsafe, materially deceptive, or prohibited by the Creative Policy. Where reasonably curable, we will provide notice and an opportunity to supply compliant replacement artwork.
10. Service limits
To the fullest extent permitted by applicable law, Brand My Van is not responsible for indirect or consequential losses, lost profits, or expected advertising results. For a claim arising from a paid placement, Brand My Van’s aggregate liability will not exceed the amount paid for that placement, except where applicable law does not allow that limit. Nothing here excludes liability that cannot lawfully be excluded.
11. Changes and contact
The version accepted with a bid governs that bid unless a change is required by law or is more favorable to the advertiser. Material changes apply prospectively and will be dated. Questions, disputes, removal requests, and legal notices should use the monitored contact details below.
